When the Court Decides Everything – Then What Is the Role of an Elected Government?

I. Introduction: Who Is Truly Governing India?

  • India proudly calls itself the world’s largest democracy. Citizens vote with hope, elect leaders, and expect decisive governance.
  • But today, a disturbing question arises — if every important decision is to be made by the courts, then why hold elections at all?
  • From festivals to faith, from security to patriotism — the judiciary seems to be deciding everything, while the government and the people stand as mere spectators.

II. When Courts Take Over Governance

It seems no sphere of national life remains untouched by judicial interference. Let’s see how this imbalance plays out:

  • Whether Rohingyas will stay in India or be deported — decided by the Court.
    Despite national security concerns, the elected government cannot act freely to protect the country’s borders and demographic integrity.
  • Whether the Indian Army can use pellet guns or what type of weapons it may use in Kashmir — decided by the Court.
    When courts start questioning the military’s operational methods, it weakens morale and endangers national security.
  • Whether idols can be immersed in rivers during Hindu festivals — decided by the Court.
    The same sensitivity is rarely seen when it comes to loudspeakers or religious gatherings of other faiths.
  • Whether crackers can be burst on Diwali — decided by the Court.
    The festival of lights is dimmed in the name of “pollution control,” yet no one questions pollution from thousands of other sources.
  • How tall a Dahi Handi pyramid can be — decided by the Court.
    An age-old tradition and symbol of devotion is reduced to a legal restriction.

III. When Sanatana Dharma and Patriotism Are Targeted

It is not just about individual orders — a pattern is visible.

  • Anything related to Sanatana Dharma, Hindu culture, or national pride faces endless scrutiny, restrictions, or outright bans.
  • But when it comes to anti-national, separatist, or anti-Hindu activities, there is a deafening silence.
  • Cases involving temple rights, Hindu processions, or cultural practices are swiftly restricted.
  • But when illegal conversions, hate speech against Hindus, or jihadi propaganda spread — there is barely any urgency.
  • The same judiciary that stops firecrackers on Diwali remains silent when violent mobs destroy Hindu temples.

This selective sensitivity raises a serious question — is justice still blind, or has it started seeing faith and ideology before facts?

IV. When the Court Steps Into Every Field

Beyond religious and cultural issues, even governance and law enforcement are under judicial shadow:

  • Whether the Ram Mandir will be built or not — decided by the Court.
    A divine matter of centuries-long faith was reduced to a legal dispute, only resolved after decades of delay.
  • Whether bulldozers can demolish illegal properties of criminals — decided by the Court.
    Instead of focusing on law and order, courts debate the “rights” of those who harm the nation.
  • Whether posters of rioters and criminals can be displayed publicly — decided by the Court.
    Protecting citizens’ safety often takes a back seat to protecting the “privacy” of wrongdoers.
  • Whether damages caused by rioters can be recovered — decided by the Court.
    Justice for victims is trapped in endless hearings and petitions.
  • Whether shopkeepers should display their real names — decided by the Court.
    Even transparency becomes controversial when it touches religious sensitivities.
  • Whether SIR can be implemented  — decided by the Court and not by election comission.
    National democratic institutions have no relevance

V. The Larger Truth: Betrayal and Weakness

  • India has been suffering for centuries — not only because of foreign invaders but because of internal traitors who hurt the country and the community for their personal and political gains.
  • These opportunists weakened our unity, distorted our history, and divided society on the lines of caste and religion.
  • Every time Bharat fell into crisis, true patriots — warriors, saints, reformers, and revolutionaries — rose to defend the motherland and restore Dharma.

But today, the danger is more complex:

  • The traitors are more organized,
  • Their networks are deeper, and
  • Their agendas are masked as “activism” and “secularism.”

Hence, patriots and protectors of Sanatana Dharma must unite again, with discipline, awareness, and organization — not just emotionally, but strategically and actively — to safeguard the nation’s soul from disintegration.

VI. The Question We Must All Ask

If unelected judges are to decide every matter —

  • Who rules this country?
  • Why and how should citizens vote?

Then What is the role of the government chosen by the people?

Democracy cannot survive when decision-making is hijacked by judicial overreach and when national and civilizational interests are trapped in endless litigation.

  • It’s time for India to restore the balance — where the judiciary ensures justice, the government governs fearlessly, and citizens live with dignity and faith in their own traditions.

Time to Awaken

  • The destiny of Bharat cannot be left to a few judgments and petitions.
  • It belongs to her people — the inheritors of Sanatana Dharma, the defenders of freedom, and the believers in righteousness.

Let us awaken again — disciplined, united, and devoted — to protect our Dharma, democracy, and nation from the forces of disintegration.
