Vice President Dhankhar’s Attack on the Judiciary: Will Arrogant Judges Change?

Vice President Jagdeep Dhankhar directly criticized the judiciary’s increasing interference and arrogance during his speech at the Judicial Academy in Bhopal. He made it clear that the judiciary must stay within its limits and should not unnecessarily interfere in the functions of the legislature and the executive.

But the real question is: Will the judges, blinded by their power, accept this truth? Probably not, as many judges consider themselves above the Constitution and behave as if they are the ‘Gods of the Earth.’

Dhankhar’s Big Question: Why Is the Judiciary Interfering in the Executive?

The Vice President raised a critical question: How can the Chief Justice of India (CJI) be involved in an executive appointment? He emphasized that an elected government is accountable to the legislature and ultimately to the people, whereas the judiciary is not.

He further clarified that:

  • Only the Indian Parliament has the authority to make laws and amend the Constitution—not the Supreme Court.
  • Article 145(3) cannot be used as a pretext for judicial overreach and misuse of power.
  • If the executive does not interfere in judicial appointments, why should the Chief Justice interfere in executive appointments?

The Judiciary’s Unchecked Power in Question

Dhankhar also questioned the selection process of the CBI Director. He asked, On what legal basis does the Chief Justice of India participate in this selection process? Is there any constitutional provision for this?

He clearly stated that in a democratic system, the CJI should not be involved in any executive appointments.

Is the Judiciary Accountable?

Dhankhar raised serious concerns about the functioning of the judiciary:

  • The courts interfere in every matter of the executive but are themselves not accountable to anyone.
  • The Supreme Court formed an expert committee on the farmers’ protest, but its report was suppressed for eight months. Even when an RTI query was filed, no response was given.
  • The judiciary’s involvement in appointments like the Lokpal, CBI Director, and Election Commission reflects a dictatorial mindset.
  • When the NJAC law gave the executive a role in judicial appointments, the Supreme Court rejected it. But the judiciary itself constantly interferes in executive matters.

Collegium System: Unconstitutional and a Hub of Corruption?

Dhankhar also pointed out that the collegium system is not mentioned anywhere in the Constitution and has become a breeding ground for corruption and nepotism. The Supreme Court must not forget that only Parliament has the authority to make laws.

He also hinted that the Modi government respects the judiciary but will not allow it to place itself above the Constitution.

Will the Judiciary Reform Itself?

Vice President Dhankhar has exposed the judiciary’s unchecked power and shown the people the truth. But the question remains: Will arrogant judges accept this harsh reality?

The Supreme Court must realize that it is not above the legislature and the executive. It must follow the limits set by the Constitution and democracy.
