Congress’s failed attempt against Hindus: Communal Violence Bill

In its attempt to gain absolute control and push a dangerous agenda, the Congress Party introduced the Communal Violence Bill multiple times between 2011 and 2013. If passed, this law would have placed Hindus at a severe disadvantage, creating a systematic framework to undermine their rights and freedoms. However, the BJP’s strong opposition in Parliament prevented the bill from becoming a law, sparing Hindus from a potentially disastrous fate.

  • Cases involving minorities during riots could not be heard by Hindu judges.

Jail Without Evidence

  • A minority member only needed to accuse a Hindu of discrimination for the Hindu to be jailed without a proper hearing.
  • The judge presiding over the case had to be from the minority community.

No Right to File Complaints Against Minorities

  • Hindus were prohibited from filing cases against minorities for violence, arson, or damage caused during riots.

Presumption of Guilt for Hindus

  • In cases of accusations by minorities, Hindus were presumed guilty unless proven innocent, shifting the burden of proof entirely onto them.

Mandatory Compensation by Hindus

  • Any loss suffered by minorities during riots had to be compensated by Hindus, regardless of who initiated the violence.
  • However, losses suffered by Hindus were not eligible for compensation from minorities.

Forced Housing Decisions

  • If a minority demanded rental accommodation in a Hindu household and was denied, they could claim discrimination, leading to legal action against the Hindu landlord.

Protection of Minorities During Riots

  • Even if riots began in minority-majority areas, Hindu men in the vicinity were to be blamed and prosecuted.

Repression of Hindu Women

  • Crimes such as rape against Hindu women during riots were not considered crimes under the bill’s provisions.

Secrecy of Accusations

  • If a Hindu was accused, the complainant’s identity would remain confidential, leaving the accused defenseless.

Control Over Hindu Religious Practices

  • Hindus needed permission from minorities to hold religious events in areas where minorities were present, effectively giving them veto power over Hindu traditions.
